General Terms and Conditions of Sale

1. Purpose

These terms and conditions govern the online purchase of products offered on www.lovida-canarias.es by Dominik Kevin Niermann.

3. Prices and Taxes

Prices are displayed in euros and include the applicable IGIC unless otherwise stated.

Prices may be changed without prior notice; the prices applicable to your order are those displayed at the time the order is confirmed.

In the event of an obvious typographical error in the price, we reserve the right to cancel the order and issue a full refund.

The actual colour of a product may vary from the images shown.

4. Availability

If an item becomes unavailable after your purchase, we will inform you. You may choose between a replacement product, waiting for the item to be restocked, or receiving a full refund.

5. Ordering Process

Select products → Shopping cart → Shipping details → Payment → Confirmation.

You will receive a confirmation email containing your order number.

6. Payment Methods

Payment can be made by bank card or PayPal.

Payments are processed through secure payment gateways. Orders paid by bank transfer will be prepared once payment has been received.

7. Shipping and Delivery

Delivery area: Canary Islands only.

Shipping costs and estimated delivery times are displayed at checkout according to the destination island.

The risk passes to the consumer when the goods are physically delivered, in accordance with applicable consumer protection legislation.

Official complaint forms (Hojas de Reclamaciones) issued by the Government of the Canary Islands are available.

9. Right of Withdrawal (14 Days)

You have 14 calendar days from the date of delivery to withdraw from your purchase without providing a reason.

How to request a withdrawal: Contact us at support@lovida-canarias.es and provide your order number.

Products must be returned unused, complete and in their original packaging.

Refunds will be issued using the same payment method within a maximum of 14 days after we receive the returned goods or proof that they have been shipped back.

Return shipping costs: In the event of withdrawal, return shipping costs are the responsibility of the customer.

Hygiene exception (Article 103.e TRLGDCU):

For health and hygiene reasons, returns cannot be accepted for sealed products that have been unsealed or opened after delivery (e.g. sex toys, intimate lingerie, lubricants or cosmetics).

👉 As long as the seal remains intact, you may exercise your right of withdrawal within the applicable period.

10. Returns of Defective or Incorrect Products

If a product arrives defective, damaged or incorrect, you must contact us within 48–72 hours, providing photographs and your order number.

Available options may include repair, replacement, a price reduction, or cancellation of the purchase with a refund.

In these cases, return shipping costs will be covered by the company.

11. Legal Warranty

New products are covered by a 3-year legal warranty from the date of delivery, in accordance with Spanish consumer protection legislation.

The following are excluded:

• Consumable goods (batteries, gels, lubricants, condoms, cosmetics, etc.)
• Hygiene products whose condition prevents proper inspection
• Damage resulting from improper use, impacts, moisture, modifications or normal wear and tear

Always follow the manufacturer's instructions.

After two years, the consumer is responsible for demonstrating that the defect existed at the time of purchase.

12. Limitation of Liability

We shall not be liable for delays or failure to fulfil our obligations due to force majeure.

Your statutory consumer rights will not be affected.

13. Retention of Title

Until full payment has been received, the products remain the property of Dominik Kevin Niermann. This does not limit your right to use the products in accordance with applicable consumer legislation.

14. Data Protection

The processing of your personal data is governed by our Privacy Policy, available via the link in the website footer.

15. Applicable Law and Jurisdiction

Spanish law applies.

For consumers, the courts corresponding to the consumer's place of residence shall have jurisdiction. Where applicable on a supplementary basis, the courts of Santa Cruz de Tenerife shall have jurisdiction.

16. Amendments to These Terms

We may update these terms and conditions from time to time. The version published and applicable at the time of purchase will apply to your order.
